1. Partner responsibility
A partner that uploads a GIF, video, image, logo, text, trademark, or any other material represents and warrants that it holds all rights and permissions necessary to reproduce it, adapt it where necessary, publish it, and allow its distribution through heypster.
Being a studio, broadcaster, producer, or distributor does not grant rights in third-party works. For example, a partner may not publish another studio’s catalog, excerpts, or creations merely because it broadcasts or references them, unless it has valid authorization from the relevant rights holder.
2. Rights retained by the partner
The partner retains its rights in the content it provides. Unless otherwise agreed separately, no intellectual property rights are transferred to heypster.
To enable the service to operate, the partner grants heypster, for as long as the content is made available, a non-exclusive, worldwide authorization limited to the technical needs of storing, indexing, displaying, caching, searching, sharing, and distributing the content through heypster services and their authorized integrations.
3. Role of heypster
For content uploaded directly by its partners, heypster provides technical functions including storage, indexing, and making content available. Partners choose the content they submit and remain responsible for the legitimacy of their rights.
The exact legal classification of heypster and the applicable liability regime nevertheless depend on the specific nature of the service and any mandatory legal provisions. These contractual rules cannot exclude obligations imposed by French or European law.
4. Referenced content and copyright
GIFs referenced by heypster may be protected by copyright, related rights, or other intellectual property rights. Their presence in heypster search results does not mean that they are royalty-free, owned by heypster, in the public domain, or freely reusable.
When referenced content belongs to a rights holder, the rights holder may request, free of charge, that it be attributed to its official account and, where relevant, that a link be added to the work’s official distribution platform. The rights holder may also report the content and request its removal under heypster’s Copyright procedure.
Referenced by heypster does not mean owned by heypster or free of rights.
5. Reporting and removal
Any rights holder who believes that content infringes its rights may send a sufficiently detailed notice to media@heypster.com, including its identity, the work or right concerned, the address of the disputed content, evidence of its rights, and the reasons for the request.
heypster may remove or disable access to content when it receives a sufficiently substantiated notice, when a partner fails to demonstrate its rights, when required by a decision of a competent authority, or when content violates these rules.
6. Protective measures
heypster may at any time request evidence of rights, suspend publication while verification is carried out, remove content, disable publishing features, or suspend or terminate a partner account in cases of repeated or serious infringement of third-party rights.
A certification badge, verified account, or heypster Reference GIF confirms the declared or verified origin according to the relevant mechanism; by itself, it does not constitute a definitive legal determination of all rights attached to the work.
